Sometimes, the answer you get is the standard reply, in the hope you will go away. Just send them another email a quote the Sale of Goods Act, about lasting longer than they think it should.

Noticed you said you hadn't changed the batteries yet. Might I suggest you put in a new set of batteries and try with that first, as old batteries lose power day by day. It might be your batteries have enough power to light the green light but not enough to fire the flash.

Here is my reply

Thank you for your email.

I empathise with your disappointment you have experienced with your purchase from ????????? and I would like to apologise that we are regrettably unable to help you on this occasion regarding your Metz 36AF-40 Flashgun.

As you purchased your camera in December 2009 we are unable to offer neither a replacement nor a repair due to the length of time you have had it. If you wish to return the Flashgun to us, we are able to send it to Introphoto on your behalf but all costs would be coverable by yourself.

As a retailer our responsibility is to ensure that the goods conform to contract at the time of sale. As this is the first correspondence to Warehouse Express since your purchase we would have to assume that the fault has not occurred within the first six months of ownership and therefore this contract has been fulfilled.

In all cases, the consumer must be able to prove that the fault or failure to conform to contract existed at the time the goods were purchased. If you are unable to do so then there is no legal redress against the retailer.

The fact that the flashgun you purchased has not lasted for as long as you expected is not in itself proof that the goods were not of satisfactory quality.

Proof that the failure has been caused by a fault that was inherent at the time of purchase would need to be verified by an independent qualified engineer. Unfortunately, if this is not possible or it is found that the fault has developed from fair wear and tear through use rather than being a pre-existing issue there would be no grounds to seek compensation from Warehouse Express.

I appreciate that this will not be the response you were expecting, but I hope I have given a clear explanation of the laws relating to this particular issue and why we will not be able to provide you with a free of charge replacement or repair on this occasion.

Kind Regards

Are you member of Which? Alf? If so, have a word with them. If you've signed up to their Legal Services better still as I think you should have some redress here.

Seek out your local CAB who should give you more infomation, and can draw up a legal letter stating the terms of the Sale of Goods Act under which you are claiming.

I gave up on this as a bad job as I was never happy with it but I have emailed Metz to give them my opinion of what a poor product it was.

I have bought a Nissin Di466 and it works much better with my camera.
