Well i dunno about you lot but when i signed in there was a new set of terms and conditions, which as i understand it means they will only publish the photo's you upload onto this website, on this website, now any of you legal speak peeps can confirm this that would be great. thought super ann would have left a message here...prob got a headache after having to read all that legal speak lol ** hugggsssssssss** John. xx

I signed in to new T&C's well could not be @rsed to read them though!!!
I got bigger and better things to worry about!

I love it, make us tick our agreement, because if we do not we can not sign in & reply to a question.

Hear me loud and clear, THERE ARE LIMITED CHANGES! Mainly the new opening paragraph which seems to suggest that you don't need to bother reading further as we've sorted it out and all's well with the world!

However if you do scroll down you will find the same, slightly altered, paragraph allowing Future to use your uploaded photos for what ever purpose they so wish, if they can claim that it's to advertise the website, without asking you explicitly (as you have ticked your agreement, and given consent by uploading in the first place). I'd go further to suggest that if you have your own web site and link to a photo from it into this forum, you are liable to have granted the same permission (I can come up with valid arguments on both sides of this). Should they use it for anyother reason, they will discuss a payment with you first, sorry "under take" to discuss it first - if they were to use it without asking first you will have the same problem you have on other sites, actually realising that your photo has been stolen and is being used for another reason. So the offending paragraph:
"With respect to Content you upload, post or otherwise transmit to the Website that consists of
images and photographs, you grant Future and its group companies a non-exclusive, royalty free,
perpetual, world-wide licence to use, modify, publish, publicly perform, publicly display and
distribute such Content: (i) on and through the Website and Website Service, including associated
newsletters; and (ii) to promote the Website. Future undertakes not to publish your images in any
other Future publications or those of its group companies without seeking your permission first.
Future and its group companies will never sell your images and/or photographs without express
prior permission, whereupon royalties will be discussed with you.
"

Please note that I'm on my iPhone, so if this is not making sense I will edit it on the computer at a later date, but hopefully it says what I want it to say... if your photo is any cop... well it's upto you!

Oh yeah, I only read this section, wlll have a read of the rest when I have more time. But to the Future team, that is a better set of T & C's (in the section I have thus far read), still not 100% fit for purpose, but getting there!

Ok, I just read the rest, all fairly standard. Though I should say, my views should not be taken as your own, please read the T & C's & make your own mind up.

The only other para which caught my eye was this:

"with respect to all other Content you upload, post or otherwise transmit to the Website, you grant Future and its group companies a non-exclusive, royalty free, sub-licensable, perpetual, world-wide licence to use, modify, publish, publicly perform, publicly display and distribute such Content (in whole or part): (i) on and through the Website and Website Service; and (ii) in any other form or medium now known or later developed."

The only thing I can think of that this refers to is what we write within the forum. Uploaded images & photos covered elsewhere, that said it is 0140 & I should be in the land of nod, so perhaps the obvious is eluding me due to my tiredness?

I'm not keen on the PR gallery anyway just for posting pics in the forums as its so clunky to use, so I just link to my own web site images plus that way they are not uploaded to PR.

But if you just upload low res web images there really should not be a problem unless you are really paranoid.

All this reconsideration of the T&C's seems to have come to nought, what is different to the original ones?

Having to sign or tick the box before you can enter is somewhat bizzare.

Having ticked the box with the 'new' T&C's does that release those images already posted under the old ones from Future's grasp, since they were posted under a different regime and those that posted them may not agree with the new ones?

Another question that I asked some time ago that has never been aswered,

If you delete an image from your gallery, does Future have no further claim on it? If that's the case it maybe an idea to maintain a rolling gallery of say 15 images which you add and delete from regularly, say over a period of one month.

I know that would be a pain for those contributors that like to post 20-30 images at a time, but it would perhaps keep your images from a possible highjack!

Hmm thats a good point Abers, maybe helpful anne might post a reply here to clarify it.
Happypaddler wow you certainly gave it a good going over and thanks for taking the time to do it, i'll give future the benefit of the doubt for the moment and just upload low res crap photo's so everyone can have a laugh heehee,mind you makes me wonder what happens to them if we sent them to the mag itsself,does the mag then have the right to publish it anywhere and any mag? can see this going on and on lol, god bless you all John.xx
