Image rights query

Hi everyone.

Sorry about posting yet another question but I could do with some clarification.

If I take a photo of, say, a National Trust / English Heritage stately home from the side of a public road or other common land (ie. I'm not standing on private land when I press the shutter), then am I right in thinking that the image I have taken is deemed to be from the public domain? If this is so, would National Trust / English Heritage have any claim to the image rights and any money earned from that image?

I know the situation with people requires model release forms to be signed, but what is the law with regards to buildings, monuments, etc.

Many thanks for any info provided.

Stu.

from what i can gather the ownership of the image wouldn't be in question it would be more of a question of the legality of the image for comercial gain

then we have the new digital rights bill so who knows where we stand today
