The rules are quite straightfoward. You can take pictures of anyone or anything not considered sensitive from a public place, such as a highway. You cannot publish images of 'identifiable' individuals without their permission with two very big exceptions that you can drive a horse and cart through - these are public interest and reportage. 'Art' definitely comes under reportage.

Think about it; if these exceptions did not exist there would be no French newspapers, magazines or current affairs on TV. Yet all of them thrive.

I sometimes ask, but usually don't because asking makes people ham up. Although hardly anyone doesn't want their picture taken, they see it as a form of flattery.

'Occupez vous de vos onions' works quite nicely when challenged, I find. Usually I must admit, prefaced by c'est un endroit publique et mes images sont mes affaires. I suppose it helps that I am 6'2" and foreign. You can always revert to je ne comprends pas.
