legal stealing?
Just read the terms and conditions for uploading photo's to this site. As i understand it if i upload a photo im granting future the rights to use it in any way they like including publishing it on other websites and magazines!!. hopefully someone can spell it out without all the techy jargon, but i for one will not be posting any photo's. bloody cheek ,:mad:

You are correct. Have a quick search for my posts - I've said a fair bit on the subject. It is also the reason I've decided to not really join in since the site went live. We were promised a re-write of the T & C's, the result being that Future must obtain the posters permission before using any image.
However in your mind (and mine) this has not been changed. I'll not go into the 5 clear specific things which must be fulfilled for a contract to be binding - but it is clearly set out within the T & C's that by posting a photo onto this site, the legal term of consideration has been met. This means Future has the right to use that photo in any way they wish - i.e. for their profit - and give the poster sweet....all. I am still hoping that they will honour their promise of changing them - so I still lurk around the site - but its doubtful this will happen. I'm sure a member of staff will be along to dispute this, suggesting that Future would always ask first - or that the T & C's do say Future must ask first - but my legal education and training clearly differs from their understandings. |

This an ongoing bone of contention and one that prevents people from posting images on the site. The last time it was raised and still remains unanswered was a couple of weeks ago on
[url]http://beta.photoradar.com/forums/showthread.php?t=341[/url] Another question to add to the list, do the T&C's apply to images posted in the Forums that are not within the galleries, if that is possible. i.e. to illustrate an example or specific technique? That used to be possible on the DCM site, but things are so complcated here, even to load an image into the gallery is a long drawn out affair. and when you finally manage it the image is so degraded that it's a pointless excercise anyway. |

Seems to be a case of wait and see what happens, i must admit im very disappointed, i buy there mag every month and was overjoyed when they annouced the web site, expected a few hiccups there always is, but them terms and conditions amounts to theft, after all they wants us to upload our photo's otherwise whats the point of the site?, i mean its bad enough on flicker, people steal your photo's and use em,****** im not gonna rant gonna see if AMY can come up with something, though its easy they can use our photo's only with our permission. loading onto this website only allows them to be viewed on this website, afterall why would we upload them ? as the great cat says *SIMPLES*

you dont need any fancy words or clever claptrap, plain and simple so we all understand where we stand, you start using legal speak and we'll all be confused even more and that could build distrust,and very well drive members away, and not just from your website. John xx |

Anything that requires the help of legal departments can take some time to sort out, we're still working on amending the t&cs to make them clearer, simpler and most importantly more photographer friendly. There are some simple ways around this - firstly don't upload and secondly, if you are going to upload, don't upload anything of larger resolution than 640 pixles on the longest side. That would limit the usefulness of the shot anyway.

Nice idea Chris, but then peeps will find it hard to comment on small images, could cause a lot of bad feeling same with watermarking, let hope super Amy and her team come up with a more photo snapper friendly terms John, xx
